General Terms and Conditions of Aramé GbR
§1 Scope
The following terms and conditions apply to all deliveries between us and a consumer in the version valid at the time of the order. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity (Section 13 of the German Civil Code).
§2 Customer's contractual partners
In the event of a contract being concluded, the contract is with Aramé GbR, represented by Tobias Nothvogel, Stegerwaldstraße 9, D-12277 Berlin. The presentation of goods in our online shop does not constitute a legally binding offer on our part, but is merely a non-binding invitation to the consumer to order goods. By ordering the desired goods, the consumer submits a binding offer to conclude a purchase agreement. The following provisions apply upon receipt of an order in our online shop: The consumer submits a binding offer by successfully completing the ordering process provided in our online shop.
§3 Information about the articles
In our online shop, we present each product with comprehensive and detailed product images. A detailed description provides information on fabrics, colors, finishes, and other features.
§4 Ordering of items, conclusion of contract and contract content
Orders are placed via our online shop, http://www.arame.eu. The contract is concluded with Aramé GbR, represented by Tobias Nothvogel, Stegerwaldstraße 9, D-12277 Berlin. The presentation of goods in the online shop does not constitute a legally binding offer, but rather an invitation to place an order. The ordering process consists of several steps, which are explained in the online shop. We will confirm receipt of your order immediately by email ("order confirmation").
§5 Prices and delivery costs
The prices quoted include statutory VAT and other price components. Shipping costs may apply.
§6 Payment terms, invoice
The consumer has the option of paying by prepayment, direct debit, PayPal, credit card (Visa, Mastercard, American Express).
§7 Delivery
Standard delivery is via DHL and is ready for dispatch within 5 business days. The risk passes to the customer as soon as the goods have been handed over.
§8 Right of withdrawal and return of products
The customer has a right of withdrawal in accordance with the cancellation policy. The withdrawal period is 14 days from the day on which the customer or a third party designated by the customer takes possession of the goods. To exercise the right of withdrawal, the customer must inform us of their decision by means of a clear statement.
§9 Exchange
(9) Exchanges are possible within 14 days of receiving the goods. Exchanges are made by returning the goods to our business address.
(9.1) The customer can exchange the item for a new one.
(9.2) The goods to be returned must be in their original condition, unworn, undamaged and complete. Price tags, labels and other attached markings must be intact and unaltered.
(9.3) Exchanges are made by returning the goods to our business address. The customer bears the direct costs of the return shipment. It is recommended to use the original packaging for shipping to ensure that the goods are adequately protected during transit.
(9.4) After receipt and inspection of the returned goods, the exchange will be processed. If the desired item is not available, the customer will be informed of alternative options. If the goods do not meet the exchange conditions, we reserve the right to refuse the return.
(9.5) The exchange process is subject to the same terms and conditions as regular shipping, including delivery times and shipping costs. Further details regarding exchanges and returns can be found in our Returns Policy and on our website.
(9.6) Please note that personalized or custom-made items may be excluded from exchange. Information regarding this can be found in the product descriptions and individual agreements. These provisions apply without prejudice to the statutory warranty rights pursuant to Sections 434 et seq. of the German Civil Code (BGB).
§10 Claims for Defects
The customer must inspect the delivered goods for defects immediately. If defects are found, the customer can contact customer service and return the products in question. The statutory warranty provisions pursuant to Sections 434 et seq. of the German Civil Code (BGB) apply.

§12 Data Protection
(12) The protection of your personal data is important to us. When collecting, processing and using your personal data, we comply with the applicable data protection regulations, in particular the provisions of the General Data Protection Regulation (GDPR) and the Federal Data Protection Act (BDSG).
(12.1) Collection and processing of data: We collect and process personal data that is necessary for the establishment, execution or termination of a legal or quasi-legal relationship with you.
(12.2) Use of data for advertising purposes: If you have given your consent, we will also use your data for advertising purposes. You can revoke this consent at any time.
(12.3) Disclosure of data to third parties: Your data will generally not be disclosed to third parties unless this is necessary for the performance of the contract, required by law or you have given your explicit consent beforehand.
(12.4) Data transmission security: Your personal data is transmitted to us in encrypted form to prevent misuse by third parties.
(12.5) Access, rectification, erasure: You have the right to obtain information about the data we have stored about you. Furthermore, you can request the rectification of inaccurate data or the erasure of your data, provided that this does not conflict with any legal retention obligations. §13 Trademarks / Industrial Property Rights
The "Aramé" brand is the intellectual property of Aramé GbR and is protected as a registered word and figurative mark with the German Patent and Trademark Office. All rights to this brand are held exclusively by Aramé GbR and its authorized representatives. The use, reproduction, or distribution of this brand without the express written consent of Aramé GbR is expressly prohibited. Violations of this provision may result in legal action.
§14 Force Majeure
(14) Force Majeure: We shall not be liable for delays or inability to perform due to circumstances beyond our control which we could not prevent despite exercising all reasonable care. These include, in particular, natural disasters, strikes, government actions and other unforeseeable, serious events.
(14.1) Notification obligation: In the event of force majeure, we will inform the customer immediately and make every reasonable effort to minimize the impact on the performance of the contract.
(14.2) Right of withdrawal: Should the force majeure last longer than four weeks, both parties have the right to withdraw from the contract. Any services already rendered will be refunded immediately in this case.
(14.3) Damages: Any claim for damages or contractual penalties due to delays or impossibility of performance caused by force majeure is excluded to the extent permitted by law.
§15 Legal dispute – applicable law
All disputes arising from or in connection with these Terms and Conditions and the contracts concluded between us and the customer are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). The place of jurisdiction for all disputes arising directly or indirectly from the contractual relationship is Berlin, to the extent legally permissible. However, this choice of law and the place of jurisdiction do not apply if the customer is a consumer and resides or has their habitual residence in another member state of the European Union. In this case, the mandatory legal provisions of that state apply.
